Looking for advice - Settlement Question

Hello,

I worked for a Big 5 Bank in Canada. Received death threats at work and was being hacked by other employee.

I was told I would receive 2 settlements per my lawyer. The settlement papers were filled with spelling mistakes, ie. if it was CIBC (it was refer to them as CZBC or something similar.

I never received the second settlement. The lawyer also mentioned to me I could return to work. Some of the actions that occurred resulted in me being on CPP-D and injured from this event.

Here is the settlement that I did receive:

They've calculated the 16-months exit package at $129,450.00.

$80,050 base-salary, plus $8005 benefits (calculated at 10%), plus
average bonus at $9030 = $97,085/year = $8090.41/month x 16-months =
$129,446.67, which they'll round up to $129,450.00 to keep the math
simpler.

--------------------------------------------------------------------------

I did not receive the 2nd settlement, and I did not get an offer to return to work. This happened in 2022.

Do I have any recourse at this point at all?

If so im looking for a lawyer who would help me on contingency basis as our funds are depleted and I have not found new employment. I had worked there from 2005 to 2022 with all stellar reviews for 17 years.

Any advice is welcome.

My livelihood, finances and ability to earn income were greatly affected by this and still are.

Thanks.

Received an Urgent Notice of Property Tax Arrears addressed to my landlord — Should I be worried as a tenant?

Hi everyone,

I came home to an "Urgent Notice: Immediate Action Required on Property Tax Arrears" letter from the city of Toronto stuffed into our mailbox.

It’s addressed to the property owners (my landlord), not me. The notice says they owe money in back taxes, penalties, and interest dating back multiple years. The letter explicitly states that if the full amount isn't paid by the end of the month:
- A $250 fee will be added to the account.
- A title search will be conducted and mortgage holders will be notified.
- The property will be at risk of Tax Sale proceedings under the Municipal Act.

My questions for the community:

  1. Am I in any immediate danger of getting evicted or locked out? From what I understand about the Residential Tenancies Act (RTA), only the Landlord and Tenant Board (LTB) / Sheriff can enforce an eviction, but does a municipal tax sale override standard tenant protections?
  2. What actually happens if the property goes to a tax sale? Does my lease agreement automatically transfer over to whoever buys the property at auction, or can a new owner easily kick me out?
  3. What is the best way to handle this with my landlord? Should I just email them a picture of the letter and keep paying rent as usual?

I have zero intention of withholding rent or trying to pay this myself, but seeing official municipal warnings about tax sales on the door is pretty unsettling.

Appreciate any advice or experiences from folks who have dealt with something similar!

Just cause termination with ESA minimums for pay in Liu of notice and severance. What’s the catch ?

If an employer terminates employee for just cause but at the same time decides to pay termination and severance per ESA minimums without even any demand from the employee, what do you think the catch is ? Are they too nice of an employer or is there something bigger they are trying to avoid ? Also is it even allowed to pay in Liu of notice of termination amount by way of salary continuance? ESA says no. Is there something else they cooking or is it mistake ? Last do you know if with payment by way of salary continuance the employer will only upload the ROE when the duration of salary continuance ends ?

On May 27, 2026, my husband and I had an argument that escalated into a physical altercation. He punched me in the head. I was terrified and afraid for my safety. To protect myself and prevent him from coming closer to me, I repeatedly swung my phone case at his arm, leaving red marks. The police arrested me because they observed injuries on him but no visible injuries on me. The case was subsequently dismissed.

On June 18, 2026, I was upset because my husband had gone to a casino, and I drank some alcohol. As a result, I was unable to pick up our child from school. The teacher called my husband and asked him to leave the casino to pick up our child, which made him resentful toward me.

When I tried to talk to him outside his bedroom, he told me, “Get out. If you don’t leave, I’m calling the police.” He immediately called 911 and repeatedly shouted, “Help, help! Don’t touch me, don’t touch me!” I believed he was making a false report to the police, so I ran toward him and tried to hang up the phone while he was making the call. He forcefully pushed and struck me, causing me to fall to the ground. As I fell, my body was moving uncontrollably, and my arm swung through the air, leaving an approximately two-centimeter superficial scratch on his face.

The police subsequently charged me with domestic violence based on the injury to his face. As a result of this case, a restraining order was issued against me, preventing me from returning home. I have no job, no income, and nowhere to live.

On October 5, 2026, my husband filed for divorce, citing the domestic violence case as grounds for requesting 100% custody of our child. He has also allegedly fabricated debts that he is attempting to make me responsible for.

On October 21, 2026, my husband kicked my older son out of the home and refused to let him continue living there because he is not my husband’s biological child.

I am now facing multiple complicated legal issues at the same time, including my pending criminal domestic violence case, the restraining order, divorce proceedings, a child custody dispute, disputed debts, and the sudden loss of housing for both myself and my older son. I have no income or stable place to live, and I am emotionally and mentally exhausted by everything that is happening.

I never imagined that my life would reach this point. I am desperately trying to find a way forward, protect my children, and navigate these legal challenges without the financial resources to obtain all the help I need.

What should I do now? Who can help me? I am urgently seeking legal assistance, safe housing, financial support, and guidance from anyone who can help me protect my rights and provide stability for my children during this extremely difficult time.

Executor Not of Sound Mind

My brother and I are both listed as executors for my aging uncle, who has no other heirs

My brother is dealing with a chronic health condition and is declining mentally and I think his wife will soon be his acting power of attorney.

What happens if we have to act as executors? Does she become my co-executor?

Record Suspension & Surcharges

Hi there!! I am currently helping someone apply for their Record Suspension. In 2014, they were convicted of a simple theft & a surcharge of $100 was added to their disposition.

The parole board is conflicting — some parts of the website say that all surcharges must be paid before the waiting period. Others say that the surcharge between 2014-2018 cannot be considered when reviewing eligibility.

Does anyone have direct experience? TIA.

“FinTech Corp” falls through regulatory loopholes. I'm fighting Neo Financial in Small Claims over an $8k fraudulent charge on Mastercard and that derailed my life. Help!

Sorry for the long post. I am living an absolute nightmare right now and desperately need guidance for an upcoming Small Claims settlement conference this November. I have no legal background, and I’m going up against a corporate lawyer.

It all started on December 6, 2025. At exactly 12:50 PM, I got an automated email congratulating me on the cashback I had just earned through my credit card for a $500.29 purchase in Singapore. I was in Canada. I tried to log in to my credit card app to lock my card, but I was completely locked out—my password and the reset function didn't work. Panic immediately set in.

At 12:52 PM, I got credit card support on the phone. I told them I was locked out and that there was a fraudulent charge. They told me my information appeared to be compromised and advised me to update my phone's software.

Here is the most agonizing part: While I was literally on the phone with their support team trying to secure my account, a second, massive transaction of $8,623.09 was processed at 1:10 PM at a merchant in Saudi Arabia. I didn't find out about it until a couple of days later because I didn't have access to my account. The hacker had managed to create a brand-new virtual card on my account to do it. The fraudster even opened a second credit card, too.

You’d think a bank would see this obvious fraud and protect you. Instead, the credit card company reversed the $500 charge but refused to reverse the $8,600 one. Their reasoning? They claimed the massive Saudi Arabia charge was "successfully authenticated" using a 3DS security code.

But here is the most baffling twist: the company sent me a decision letter explicitly admitting that an intruder had taken over my account, changed my password, and changed my profile email address. They fully admitted in writing that the 3DS security code used to "authenticate" the $8,600 charge was sent to the hacker's newly updated email, NOT mine. Yet they still hold me 100% liable.

I tried going through the normal regulatory channels (OBSI and provincial consumer protection). I was told that because the company operates under a "fintech model" rather than as a traditional bank, it falls through a jurisdictional loophole and these agencies can't do anything to help me.

Left with no other choice, I pursued a claim against them in Small Claims Court. I served them, and they fired back with a formal Reply drafted by a lawyer. Their defence? They are claiming I breached my cardholder agreement by failing to keep my security credentials confidential and failing to safeguard my account. They threw in standard legal boilerplate: "Except as expressly admitted herein, the Defendant Financial Technologies Inc. denies each and every allegation contained in the Notice of Claim of the Claimant and puts the Claimant to the strictest proof thereof."

In order to prove that I have taken all necessary steps and gathered evidence, I requested my information from them under PIPEDA in February. To make matters worse, they are completely ghosting my formal PIPEDA (Privacy Act) requests for access to my account information, such as logs, notes, IP addresses, and phone transcripts.

This has completely derailed my life. I was supposed to buy a home early this year, but my mortgage broker has given me written confirmation that no lender will lend me the required amount right now because of the $8,600 balance hanging over my head and tanking my credit score. Lenders will either deny me entirely or offer only a significantly lower amount that won’t buy anything in my geographic area. I am paying the minimum monthly payment under protest, but they are charging a hefty 23% interest rate, which is basically impacting my credit utilization.

I am terrified to just pay the $8,600 to clear my credit, because I know they will just take the money and I will never see it again. This has caused me severe mental distress for nearly a year, as I watch my homeownership goal slip away over a fraud they watched happen. Now the interest rate is also higher than earlier this year.

My questions for anyone who has gone through this kind of situation, or for anyone with suggestions:

How do I handle the settlement conference? Going up against a hired corporate lawyer next month is terrifying. What factors or strategies do I need to focus on?

Can I use their silence against them? How do I prove to the judge or mediator that they are stonewalling my legal PIPEDA requests and refusing to hand over the information I need to prove my claim?

What would be use as evidence to prove damages? I have written evidence from my mortgage broker showing exactly how this is destroying my ability to buy a home. Is this enough to claim damages for the real estate impact and the mental toll this has taken on me?

Any advice on how to navigate this would mean the world to me.

I know this post might sound a bit emotional, but it is draining. Thank you for reading, and I appreciate your time.

CAF Payor for child support did not disclose lump sum retro pay raises in 2017, 2021 and 2023.

Hey everyone,

I’m looking for feedback, advice, or shared experiences from anyone who has successfully gone through the Canadian court process for retroactive child support recalculation—specifically involving a Canadian Armed Forces (CAF) payor who failed to disclose backdated Treasury Board economic pay raises.

Here is the situation:

  1. Background & Non-Disclosure

We have a 2015 Consent Order requiring both parties to exchange full tax returns and NOAs annually no later than June 1. I have primary care of our child.

He has failed to provide annual tax disclosure voluntarily since 2013, only providing numbers when pushed or when updating base amounts manually.

  1. The Hidden Backdated Lump Sums

After finally pushing for updated disclosure through legal counsel, I discovered he received multiple retroactive Treasury Board economic pay adjustments that were never disclosed when setting child support:

2017 Lump Sum: Backdated all the way to 2014.

2021 Lump Sum: Backdated all the way to 2018 (he reported a higher line 15000 in 2021 but didn't disclose it was a multi-year backdated raise, nor did he provide tax docs for 2017–2020).

2023 Lump Sum: Backdated to 2021 (again, received as a multi-year lump sum without disclosing the breakdown or providing earlier years).

  1. His Current Resistance

When I formally requested his missing 2017, 2018, 2019, and 2020 CRA tax disclosures to calculate the true retroactive arrears, he ignored the request. He is now claiming he is "retiring soon," threatening legal fee claims, and arguing through his lawyer that we should just "set past support aside" until his future income is figured out.

  1. Next Steps

I filed an affidavit detailing his continuous non-disclosure, and we have an upcoming Settlement Conference on November 9. Our strategy is to request a binding Disclosure Order forcing him to produce his 2017–2020 NOAs and military pay breakdowns (MPRR/pay statements) so we can do a proper year-by-year recalculation under Colucci v. Colucci.

Questions for the community:

  1. CAF Back-Pay Reallocation: Have you or your lawyer successfully gotten a court to reallocate multi-year Treasury Board lump sums back to the actual tax years they were earned (spread-back method), rather than treating them as a one-off bonus in the payout year?

  2. Multi-Year Retroactive Recalculation: For those who dealt with deliberate non-disclosure of CAF raises going back 8–10 years, did the judge bypass the standard 3-year retroactive cap under Colucci due to blameworthy conduct?

  3. Retirement Defense: How did your judge handle the payor trying to use "imminent retirement" as an excuse to avoid paying accumulated past child support arrears?

Any insight, CanLII case references, or advice on framing this at the settlement conference would be greatly appreciated!

Why is it so hard to find para legals in Toronto who will respond?

You fill forms on shitty websites and get no response and when you do the ones that respond ask for 2500$ + tax as flat fee.

Is this the going rate for paralegal help for small claims court ? Makes the whole thing kinda useless … I am claiming more than 10k so I thought I’ll consult a professional to increase my chances and approach this the right way. Are we just fu###d ??

If you’re a paralegal who can help me please DM
