Mod Post Read before commenting: Off-topic and anecdotal comments are not allowed and subject you to a permanent ban

Greetings from the mods!

We've had a flood of off-topic comments recently. We're posting this to remind everyone that off-topic and anecdotal comments are not allowed. An off-topic comment may subject you to a permanent ban.

The Rule:

Commenting Rule 1: Comments should contain a legal answer or a strongly related non-legal answer. If it is not legal advice, do not post. Period. You will be banned.

What is "off-topic?"

Any response that doesn't answer the question by reference to legal information or principles. A joke, a wisecrack, a comment about OP's formatting (use the report button instead) are all off-topic. Off-topic also includes expressions of sympathy, opinions on the law, and comments that berate the OP or anyone else.

Incidentally, simply adding "get a lawyer" to an off-topic comment does not make it on-topic. And "get a lawyer" on its own, without further information or help, is considered unhelpful and may be removed on that basis.

If you want to discuss a post, then wait until it hits /r/bestoflegaladvice or ask a question about the subject of the post in /r/legaladviceofftopic. The main subreddit and a comment thread are never a place to have a philosophical discussion about the law or the post. It is a place to answer the questions asked.

What is an "anecdote?"

For our purposes, anecdotes are stories about something that happened to you (or someone you know or heard about) who may have had something that might be similar that happen to them.

These comments are not helpful. They do not include current legal information that is relevant to the OP, and therefore, they are off-topic. If you know the answer to the question (based on current law and relevant jurisdiction) then just answer the question without the story.

Another type of anecdote is "I don't know the law in the jurisdiction you actually asked about, but in some other state, the law is..." That is just not helpful. Laws are different in different places. These types of answers are off-topic.

Referring an OP to a thread on a different subreddit, or to somewhere else on the Internet because it might include a similar situation, is anecdotal advice and not allowed.

These are not the only types of anecdotes, but they are probably the most common ones. Again, if you are not referencing legal information or principles, your comment is probably not allowed.

Violations subject the user to an immediate and permanent ban

Not that we need to justify enforcing our rules, but this is a busy subreddit and the mods have a lot to do. If a user shows up here, doesn't read the rules, and posts a single off-topic comment, the user may be immediately and permanently banned.

This policy is not intended to be punitive, although we know it may seem to be. There are a lot of you and not many of us, and banning users that do not follow the rules, even once, is in the best interests of the subreddit. Violating the rules almost always means the user didn't bother to read them, and we simply don't have time to deal with such users.

Tl;dr: Unless you have a legal answer, do not reply to any post in this subreddit. You may be permanently banned, even for a first offense.

Subreddit Rules

We've learned that some people just flat out can't see our subreddit rules, so I'm posting them here in a pinned post so we can link them when necessary and so they're super easy to find.

Rules for r/legaladvice Rules that visitors must follow to participate. May be used as reasons to report or ban.

1. All responses must offer an answer to the legal question posed by the OP. We enforce this with bans.

Anecdotes are not permitted. Neither is advice that encourages someone to break the law. Nor is "get a lawyer" a sufficient response.

There's a pinned post at the top of the subreddit specifically addressing this rule. We will absolutely ban you for commenting without answering the legal question

2. Personally Identifying Information

Posts or submissions that ask for or contain information that could be used to identify either party are subject to immediate removal.

3. Advertising or Recommending a Lawyer or Business

We do not allow referrals to particular lawyers, law firms, or other businesses.

4. Do not request or send a PM

All discussions must stay on the subreddit for everyone's protection.

5. Include your location

You must include your location in the following format: location: yourlocationhere . It must be that exact format, and it must be in the body of your post.

6. Read our full list of rules

Read our full list of rules here: https://www.reddit.com/r/legaladvice/wiki/index#wiki_general_rules

7. This subreddit is for simple legal questions.

This subreddit is for simple legal questions. We can't help with preparing a defense, legal research, etc. We cannot review contracts, plan your defense, or give you specific advice on exactly how to present your case with the court. You need a local attorney for that. Additionally, we do not accept medical malpractice questions.

8. NO LLMS

No LLMs. No ChatGPT. Don't recommend it, don't use it to answer questions, and don't use it to compose your modmail when you get banned for using it. Using it to compose questions is generally ok.

We will permanently and irrevocably ban you for this.

9. Mods can remove things we deem inappropriate or disruptive

Any post and any comment can be removed by the mods at any time if the mods decide the post/comment is or has the potential to be disruptive or is otherwise inappropriate.

10. Posts must be about a real scenario that you or someone you know is facing.

To expand on this, we additionally do not allow anyone but the immediately involved parties to ask custody related questions. Not friends, not significant others, not grandparents. Reddit is free.

11. Post must contain a legal question

A legal question is one that can be answered with the law, be it a law or ordinance, or caselaw.

12. US and Canada only

Laws are different everywhere. We can only help with legal problems in the US or Canada because we have no regular, reliable commenters from other countries. For other countries, please search for an appropriate subreddit.

Neighbor’s dog is dead and has been decomposing in their yard for days

3.8k Upvotes

Location: Ventura County, CA

Hi all. My neighbors have 2 dogs. 1 dog is dead and has likely been dead for several days based on what I saw of the body. I got suspicious of a foul odor I had been smelling for several days whenever I would step outside and finally took a look out of our window that overlooks the neighbors yard and could clearly see the dog in a state of decay.

Meanwhile the other dog is still alive but is outside with the dead dog, at times I could see it lay down next to it and it’s extremely sad.

These neighbors have, to my knowledge, never taken good care of these dogs. They are left outside 24/7 and never let them in even during high heat or rain. Don’t think they have bed or shade. Don’t know how often they are fed or have clean water. They pick up poop once every few weeks. I don’t know why they decided to get 2 dogs if they are not going to take any care of them. They are not home much, as far as I know they leave early in the morning before 7 and get home after sunset. Don’t know if they go to bed early because I hardly see lights on in the house

When I first saw the dead dog on Friday 10/23 I called the non-emergency police number. They told me that this is an animal services issue and to call them. I called Ventura county animal services and they told me to fill out the animal abuse/neglect form online, which I did. I called VCAS again yesterday 10/24 because it didn’t look like anyone had came out yet. They basically said the person who handles new reports was out that day and to try again Sunday or Monday. Today I called the local police again and asked if there is something they could do like perform a wellness check in the animals or something, but they again told me this is an animal services issue.

My question is, is there anything else I can do? Or is it just a waiting game for VCAS to respond?

A cemetery that butts up to my mom's new house is trying to expand could she be forced to sell?

Location: MA

My mom and her fiance just recently bought a house for cheap because the backyard butts up to a cemetery and they have a brick wall that divides them. However they recieved a letter in the mail from the cemetery owners they want to buy their house to expand and included an incredibly lowball offer of about $50k. These letters were sent to over 100 homes around her as well as some commercial buildings nearby (restaurant, dentist office, etc.) She wanted to know can the cemetery claim eminent domain on the land? They just got this house a month ago they really don't want to move again.

Personal Injury Can I be sued for pushing a toddler?

1.6k Upvotes

Location: TN

My son attends a church daycare in TN. There have been reports of a serial “biter” in the classroom. There’s been a week where he’s been bitten almost every day. We’ve documented this and consistently been pushing for the other child to be moved to another class.

Today we had a Halloween trunk or treat where each class went around the parking lot. Lo and behold when they arrived to my station, my son got super excited and was jumping up and down. Said biter quite literally unprovoked latched himself on my son’s arm. I jumped up and shoved him down to save my child. Child was totally fine but crying.

Of course no one saw it. Admins asked what happened, I said my side. Said any camera footage would back me up.

They said no big deal and an accident report will be sent (anything and everything gets an accident report sent to parents).

The parents found me in the parking lot little while later and said they’d sue me and were dead serious about it. Apparently as of tonight they unenrolled their child.

Am I in trouble or what?

Other Civil Matters Car dealership owner got deported

Just as the tittle says. Purchased a vehicle in Ohio and expected to receive the tittle in the mail.
Hadn’t heard anything in a couple of weeks so I reached out to the seller on FB. He claimed he’d been deported and the business was being shut down.
I’ve also reached out to his business partner who had been responsive up until 2 weeks ago. He just reads my texts and doesn’t respond.
Pretty sure I’m shit outta luck on getting that tittle.
What are my next steps? I have carfax with a matching VIN as well as proof of purchase documents.

Real Estate law City approved a stormwater collection tank that discharges onto my property

• Upvotes

I have piece of property within a city in Montana. The city approved and allowed to be built a storm water collection basin where the over flow directly discharges onto my property and is causing significant water accumulation and runoff on my property. The city at this point is not willing to address the issue. Ive had phone conversations and site visits with the department head. His only answer is for me to have engineering done, get the design approved by the city and then have work carried out, all at my expense. I understand if this was naturally occurring drainage I would be responsible, but this is a direct result of this collection basin and discharge pipe.

Location: Montana

How should I proceed? Thank you.

Son’s school is taking me for court for truancy.

Location: Pennsylvania. (First post deleted bc there wasn’t an actual question. Sorry about that)

I have never posted on Reddit before, but I am at a loss. My son is 5 yrs old. He started kindergarten this year. He is diagnosed with autism level 3, ADHD, and traumatic brain injury. All three of these issues are known to cause problems with sleep. The school is aware of all of these diagnosis. He also went to pre school there last school year. He doesn’t have an IEP yet for this school year.

Before we started him in school, we were told that the school will work with my son. They will structure his day to help him. They used the example that if he needs to go only 3 days a week or have shortened day.

He has missed days yes, but all due to his sleep. The school said 19 days. (This is incorrect). They called Children Youth Services on us. We had a meeting with a lady last Friday. I explained everything. She looked at his “unexcused” days. She said a handful of them were excused. She also said the first week of school that he missed due to the school not having bussing set up didn’t count as unexcused. (just so happened my cars battery went, and I wasn’t able to take him)

We had an attendance meeting already. The principal wanted him to be there every day, regardless on how he slept. He was sick with a doctor’s note that week. I kept him home. And I feel like she’s power tripping because we didn’t make him go when he was sick.

Because after that CYS called for the appointment . Today, I got a notice to appear at local magistrate due to his attendance.

But what I’ve read is that
1.the school miscounting days is illegal.
2. The school doesn’t have an IEP for him. I asked them to update his and his teacher said that “ because he hasn’t been going regularly”, she hasn’t been able to complete one. ( he had one in pre k). I read that they can’t use that as an excuse.
3. I also read that they shouldn’t have contacted CYS/ courts because of his diagnosis’.

Also to note, his very first day, he came home with two big scratches going up his leg. Some teacher/aid hurt him. His family doctor agreed along with his behavioral consultant. Then the week after, I got a call from his teacher stating that he fell. My first question was “did he hit his head” due to his history of traumatic brain injury. She said “no, he caught himself on his hands.” She said he was lying down (not like him) and wanted to know if anything helped him to feel safe (toy/ blanket). Then I get a call from the nurse 2 hours later saying “I know the teacher called and let you know he hit his head….” I told the nurse “no, she specifically said he didn’t hit his head.” I ended up taking him to the ER to get checked out. Both these instances, the teacher and school has dodged answering questions about these. (I have messages from the teacher not answering or vague)

We have been hesitant to send him in the first place. He is mostly non-verbal. Him being scratched and him hitting his head, along with lack of communication from the school has also made us scared to send him. On top of his problems sleeping.

Also, one night when I put him to bed at 9:30, he woke up at midnight, and was up until 5 am. I kept him home that day, I had called the teacher to tell her. She said keep him home bc when kids don’t sleep, they usually act up/ don’t get anything done. Now it’s a problem. I have messages referring back to what she said about keeping him home if he doesn’t sleep.

What are the next steps I should take?

Sorry this is long. Lots have happened. And I have never dealt with this. I just want to protect my son. Any information is really appreciated. Thank you for taking the time to read/ answer.

Landlord Tenant Housing My ex boyfriend wants his half of the security deposit.

Location: Ohio.

Hello. My ex boyfriend broke up with me Monday. We signed a 2 year lease. When we moved in, he paid me his portion of the security deposit which I forwarded to the landlord.

Im staying in the rental. He refused to pay half the fee to break our lease, and he said he cannot afford the rent on his own. He moved his stuff out last night. He is now demanding I pay him his half of the security deposit. I dont have the extra money right now. I told him when I move out I would give him the full amount. Does he have legal standing to sue me for his half?

Edit: if we sign an addendum removing him off the lease, could he sue me?

Thank you.

CPS and Dependency Law My son called CPS to "punish me"

2.2k Upvotes

Throwaway account

Location: Oklahoma

My oldest son, 15, convinced his girlfriend's Dad to call CPS on me.

They told CPS that I starve and severely abuse my autistic son. I don't have an autistic son. The worker told me the allegations were that I have done things like throw him to the ground and kick him in the sides, punch him, refuse to feed him, scream at him if he tries to get food, allow my significant other to strangle him, that i'm an alcoholic, etc.

None of this is true and I was completely shocked. She found no alcohol in the house, no evidence of new or old injuries on any of the kids and of course the fact that none of them are special needs. None the less she said that the allegations came from a credible source so she will conduct her investigation over the course of 50 days and is requiring me to attend anger management, parenting classes and counseling. She wants me to sign release papers and give her family contact information.

After she left, my son told me what he had done and not to worry because he would " call her and put an end to all of this tomorrow". He really thought he could use CPS as a pawn to get back at me for not giving him his way. I explained to him that isnt how this works and if he calls her it would only make me look worse, like I intimidated him into doing it.

What do I do? Do I need an attorney?

Traffic and Parking AI had my friend's car towed erroneously, now he's hundreds of dollars out of pocket.

Location: Anaheim, California, USA.

I'm with a group that walks in the Anaheim Halloween Parade every year, and every year we park at the same parking garage, which offers free public parking on the day of the event, to meet and get into costume before the parade.

We park near the top of the garage for added privacy since we have to change into costume in the garage. One of our members chose a corner spot on the top level for added privacy. There were plenty of empty spaces before, during, and after the parade in this parking garage.

When we were done with the parade and returned to the garage after the shuttle back, one of our members' cars was gone. Police told him to look around in case he misremembered where he parked, but even after checking the neighboring garage, his car was nowhere to be found.

It turns out the garage now uses AI to monitor parking, and erroneously marked his car as being in two spaces. The tow company towed it even after the tow driver remarked that the parking job looked fine.

There’s video cameras all over the garage. AI reads your license plates and starts a timer for charging you by the hour. It also sees where you park. I parked in the corner and as far towards the empty corner as I could so I could use the space where nobody can park for charging into my costume. The AI says my tires were out of the space and I was taking up two parking spots. I may have had one tire on the line but not beyond it and it was the line towards the corner where nobody could park because I had about three feet from the other side of my car to the line that separated my spot and the adjacent spot. AI called the towing company on me and just said I was in violation of the parking policy. The tow truck driver arrived and couldn’t see anything wrong with my car and called his dispatcher but they told him they weren’t given a reason and he had to tow it became it was a busy night and they had a lot of other calls. I can’t get my car out of their yard until Monday so I had to rent a car for the week because I work in Palmdale Monday- Thursday so I can’t pick up my car until Friday so I’m going to have to pay $150/ day for storage and the $250 towing fee

Wondering what he can do to be reimbursed for all of his expenses for the towing, impound fee, plus the rental car he needs for his employment.

Hidden Camera in Break room

Location: California
I work for a “high end” independent living community and work nights alone till around 7am when the manager and cooks come in. While taking my break I found a hidden Ring camera plugged in the break room with black tape covering the light. This particular camera records both video and audio which I’m sure isn’t legal in any regard. There was no announcement about a camera being in there or anything posted about this. I took a photo and video on my phone of when and where I found it, also the wall plug it was connected to had a sticker on it that indicates it belongs to my workplace. Then while clocking out at 8am I seen the camera was missing from the break room, only the manager and 2 cooks had access to it in that time. I am extremely uncomfortable and am unsure how to move forward legally since I don’t think management is the wisest people to go to first about it. Any help would be very much appreciated thank you.

Alcohol Related Other than DUI My job is asking me to break the law. I think.

I manage in a place that serves alcohol in New Orleans. Upper management agreed for my staff to serve cocktails to guests arriving to a location a few blocks away, off of our property. I voiced my concern that this was not permitted under our liquor license. I am also concerned about liability for taking staff off of our property. What if someone gets hurt? I was essentially ignored as overthinking it. Am I? Can I be held personally responsible? Drinking in the street is legal here. So the guests are not doing anything illegal. Management seems to think if we’re not charging them in the moment that it’s fine.

Insurance Neighbors nonverbal child keeps climbing onto my garage roof.

Hello!

Long time lurker, first time poster.

Location: California

I have a neighbor who has 2 young autistic boys that are nonverbal. Both are under 10 years old. We share a fence that borders my detached garage and their built in outdoor kitchen. We’ve been in our home 6 years, they moved in last year.

Over summer their older son climbed onto their kitchens counters, then the fence, then onto our garage roof. We had to run next door to tell them their son was on the roof and to get him down before he got hurt. They assured us they figured out how he did it and they fixed the problem and it wouldn’t happen again. No further incidents for the rest of summer.

Fast forward to yesterday & today. He climbed onto the roof yesterday afternoon, and again during the evening while we had 40+ guests in our backyard for a birthday party. He promptly gave all in attendance a heart palpitation. The second incident yesterday when I ran Nextdoor to alert mom/dad…they didn’t even know how he got out or that he was outside. Again, just a few mins ago this morning…he was on the roof. Three times in less than 24 hours.

He’s only going to get taller and stronger and find new ways to climb up. It seems to be his new fav spot.

I don’t know what to do….what if he climbs up when none of us are home and falls and gets hurt? What do I do?! I’ve talked to mom/dad and they keep assuring me they’re keeping eyes on him/not letting him outside by himself.

This is giving serious anxiety. How do I protect my family legally in the event he hurts himself on my property?

Thank you for any advice you guys may have.

Other Civil Matters Fostermom's boyfriend stole plates off my car without anyone's knowledge while i was asleep

Location: Texas, DFW;

i dont rly know how to attach this video, sry

Yesterday, i went to work as a waitress at 9am, and came home at 11pm due to the saturday rush, and my car was perfectly fine, untouched, both plates are there. Next day (today) i wake up at 8am, get ready and call my uber to leave to work. As I walk outside, the boyfriend is outside smoking a ciggy, and i IMMEDIATLY notice my car (1991 Ef Civic) is missing both it's front and back plate, with a socket sitting on the floor near the front plate. I should mention that the plates are regestered and up to date, i just dont have current insurence on it as its sitting on the driveway while I work on it. I start freaking out and pacing going "holyy shit someone stole my plates" and the boyfriend is just watching me. and once i mention the police he goes "Oh i took them off and put them on a truck" which catches me SO off guard, I stand for a moment and go "wow alright, okay than" hand him the socket i found on the floor near my car, and im just sort of glad they werent just stolen from someone randomly, and i had other things to worry about, like catching the uber infront of the house and not missing my 3rd shift working there. And so I think to my self "wow ill just deal with this later, thats weird as fuck." later into the shift, i ask my coworker, whos the daughter of said mother(yea she got me the job) to text mom and ask for her boyfriend to bring my plates back, cause thats weird, and moms like "i had no idea he took them, i'll tell him." so boom, shifts over, i go home at like 12pm (nearly 14h) shift, and my front plate is STILL missing, but the back plate is now there. So I come inside, think oh maybe the plate is inside, i really dont feel like dealing with this bs, and so i go to ask him, and its straight too "Their was only one plate, their was never a front plate." mind you, ive had this car for 7 years, and just got new plates for it. and so he lossses his shit and is yelling in my face and i keep my cool, newborn is in the room and im tellling him to calm down, whole family starts freaking out, so i finaly step outside of the room and sit down in the living room to take a breath, and he walks outside to smoke a cig. i recorded mostly the ENTIRE conversation/argument we had. afterwards, i decide wow, im just going to call the police and report my license plate as stolen, since he claims it wasnt him, he should have nothing to worry about, so i leave the house to go on a walk and as im taking a stroll i put the police report in that someone stole my plates, and that was that. When i was first leaving the house i should mention he appolgised for yelling or whatever and i told him its whatever, we're cool, dont worry about it. i rly dont want this shit to drag on and have to be wery of this guy who sleeps in our home like everyday augh. sooo im hoping i did the right thing, is their anywhere i should go with this or am i a fucking dumbass.

Criminal Law Being extorted, but reporting it may get me charged with a crime as well. Fl

Location: Florida.

I'm being blackmailed and extorted by someone, I stupidly caved and paid every time they said it would be the last. Already out near five figures. They went silent for a few days, I assumed they were smart and quit while they were ahead.

But they've started back demanding money again, and again promising this will be the end of it.

Now that my panic is gone and the anger is there, I'm ready to tell them to pound sand or I'll go to the police, or just go to the police without responding.

But doing so, I would have to self incriminate to a misdemeanor.

I have been trying all afternoon to speak to a local criminal defense attorney but have had no luck yet. Only four had a 24 hour answering service. One said they won't even consult until I'm charged. The other three all said the attorney was with anothrr client and would call me within 30 minutes. Pushing two hours now with no call back from any of the firms.

So while I anxiously await one of them to call, what can I do here to end the extortion and limit the potential to be charged myself?

Landlord Tenant Housing Landlord failed to inform me of parking restrictions and then HOA had my car towed

• Upvotes

Location: alachua, fl

My lease does not include any information about parking. My landlord told me that the two parking spaces in front of my apartment belong to me and I can use them for visitors or myself and do not need to provide any additional information to him. I recently bought a new car and put my old license plate on it and parked the old car without license plate in one of my parking spots.
I got a doorbell notification a few days ago and saw a towing company breaking into my vehicle and towing it. It cost me $200 to get back and I called the police because I thought they weren’t allowed to go inside my vehicle and as far as I knew I was being wrongfully towed.

The police called the HOA and confirmed it was them who requested my car be towed due to having no license plate stating that this is an HOA policy.
My landlord stated in text message that he knew it was an HOA policy. My lease does not include any HOA information, policies or contact information. It also does not include any information about parking.

I asked my landlord to take the $200 off my next month of rent and provide me with a copy of all HOA policies since I am now living in fear that they can confiscate any of my property that does not align with their policies while I have no knowledge of said policies. He left me on read. What should I do?

Can I face legal or professional consequences for exposing a customer who threatened to call ICE on my family?

• Upvotes

Location: Texas

I’m looking for advice on a situation that happened at work and want to understand the potential consequences before deciding what to do.

I recently had a customer who was concerned about something happening during her transaction. I was trying to reassure her and said, “Girl, we would never do that to you.” She immediately responded by telling me not to call her “girl” because she was an attorney. I apologized right away and continued helping her with her other concerns.

Later, we were waiting in another area of the store while she looked at something, and she started cursing me out. I could tell the situation was escalating, so I pulled out my phone and began recording, primarily to capture the audio in case I needed documentation of what happened.

During the interaction, I told her that a higher-level manager would be following up with her regarding her behavior. She then said, “Yeah, well, your family is going to hear from ICE.” The entire exchange was captured in my recording.
She also explicitly said she made that comment because I had called her “girl” and because she is Black. I understand that my wording was overly familiar, and I apologized for it, but I was not addressing her that way because of her race.
After the incident, I found out that she is actually an immigration attorney.

Now, I’m considering sending the recording to a local Instagram account that shares community incidents so the interaction can be brought to light. However, before I do that, I want to understand what I could potentially be getting myself into.

Could I face legal consequences for sharing the recording publicly? Does it matter whether her face is visible if the audio captures the conversation? Could I get in trouble with my employer for posting it, especially since the interaction happened at work? And could there be any additional consequences because she is an attorney?

I’m not trying to put myself in a bad position by acting out of frustration, so I want to understand the risks before making a decision.

Is there any way to like sue the other driver for like damages. I have no idea if they are charged with like a dui and the police are not helping much. Help how can I hold the other party accountable. I

Does repeated camera surveillance over a privacy fence qualify as civil harassment in CA

• Upvotes

Location: Los angeles, California

Wondering if this sounds like enough of a documented pattern to speak with a lawyer about a civil harassment restraining order.

I’ve had an ongoing dispute with my next-door neighbor involving:

A very bright ~7,000-lumen floodlight pointed directly into our backyard/home for an extended period. Code enforcement eventually took action and required shielding.

A camera positioned through a gap in our privacy fence looking into our yard. When I put a tarp on my side to block it, he confronted me and said things like, “You wanna dance? Let’s dance.” I have the interaction recorded.

I later put up an approximately 8-foot privacy fence specifically to get more privacy in my backyard. After that, he installed another camera very high under his roof eaves, roughly 13–15 feet up, which can see over the fence and into my backyard. I also have video taken from inside my living room where I zoom in on that camera and you can clearly see its lens pointed directly toward me/my living-room windows.

There are several other cameras along our shared fence/property line as well.

Most recently, he installed another PTZ/motion-tracking camera on a pole immediately next to my privacy fence. My fence is about 7'8", and this new camera is mounted on a pole and sits roughly 2–3 feet above the top of it. I have video of the camera rotating and tracking me while I’m in my backyard.

The newest pole-mounted camera is basically right in front of our living-room/window area, and I have photos/video showing the lens from both my backyard and inside the house.

I understand that simply owning security cameras isn’t automatically harassment or illegal, and that automatic motion tracking doesn’t necessarily mean he is manually controlling the camera.

My concern is the overall pattern: I’ve repeatedly taken steps to create privacy on my property, and the cameras have been positioned in ways that allow them to see over or through those privacy barriers and toward my backyard/home.

My question is whether these incidents taken together sound like the type of documented “course of conduct” that could support a California civil harassment restraining order, invasion-of-privacy claim, or injunction requiring the cameras to be repositioned.

I have original photos/videos and code-enforcement records documenting much of this. I’m considering speaking with a lawyer before taking any action.

Getting sued by other victim after a hit and run

Location: nyc

July 4th my car was street parked and hit overnight pretty hard. My car was pushed about 3 feet, into the car that was parked in front of me. The next morning i talked to the other victim, called 911, got my police report filled out etc and then called insurance (GEICO). I did not have collision, only liability and comprehensive, which i thought would cover it. Ended up paying for the repairs to my car out of pocket after geico refused to cover any damages.

Today in the mail i find out the other victim is taking me to small claims court for the damage to his car. The hearing is in august 2027. I left geico a message on the claim, waiting to see if they will involve themselves at all

Am i right in thinking i shouldnt talk to the other victim any further? Hire a lawyer? Should i just show up and present all of this info to the judge myself? I have pics, police report, insurance claim# etc

Any advice is greatly appreciated. I dont have the $10k that this guy is after.

Money stolen from our Chase account, claim denied, what can I do ?

My fiancé and I are looking for advice after unauthorized activity on our Chase checking account.

Our original debit card never arrived. We learned from USPS that mailboxes in our area had been broken into. We removed all money from the said account and was going to have it close in the 60 days since no money was in it.

Then there were unauthorized ATM withdrawals and an attempted check deposit involving our account. We reported the activity immediately. Chase initially credited some money back, but later denied our claims. We even got a text message saying fraud was happening and we responded back saying yes it is fraud.

The explanation we were given was that a debit card and PIN were used. But we never received or activated the original card, and we never created a PIN for it. That is the part we keep trying to get someone to investigate and explain. We have asked for security footage from the ATM. We have contacted everyone we can get ahold of a Chase. Everyone is shutting us down.

We’ve called Chase, visited branches, and filed a government complaint, but we still haven’t recovered our money. We also provided a location screenshot showing we were somewhere else when the activity occurred.

This was money we were saving for our future wedding, and it’s incredibly frustrating to keep asking for help without getting a resolution. We now are out of luck for a wedding fund.

We talked to someone else again and they said it’s been over 90 days and they have deleted all information connected to the account. Even though we had open fraud claims on the account.

Has anyone successfully appealed a similar Chase denial, especially involving a debit card that never arrived? What helped get your case reviewed properly? We’d appreciate recommendations.

Thank you to anyone who can share firsthand experience or point us toward a useful next step.

Credit Debt Bankruptcy Can credit card companies come after my girlfriend?

• Upvotes

I have friends that have lived together for over 32 years. They are not married, have lived in New Hampshire for the last three years, and prior to that they lived in New Jersey. They have not combined their bank accounts but they are both listed on the house deed and mortgage. If the man dies leaving behind tremendous credit card debt, can creditors come after the woman?

Traffic and Parking How to mitigate consequences of a speeding ticket?

• Upvotes

Location: Kansas.
Got the ticket in Kansas but I’m currently in Utah

Hi everyone. I have a Virginia license and will be switching over an Utah license soon in case that is relevant. While driving through the state of Kansas a cop got me going 90 in a 75. It will be my first speeding ticket. I’m not worried about the cost of the ticket as I can easily pay that but I’m wondering if there is a way to mitigate the consequences of the ticket by calling the County Clerk’s office before I pay online. If it helps my case at all the road was completely empty of anyone besides me and the cop.

Any advice of how to go about mitigating ticket consequences remotely would be appreciated.

Wills Trusts and Estates NY Intestate Estate: does an NY Estate bank account have to be opened at a bank physically in New York?

• Upvotes

Location: New York (Surrogate's Court, New York County)

I'm one of two co-administrators of a relative's intestate estate. The decedent lived in NYC and the court recently issued Letters of Administration. We both live in other states (FL and CA, respectively) and we need to open the Estate account to get the ball rolling on collecting the assets and paying any creditors.

Our attorney says that under New York law the estate account must be opened at a bank in New York State, and that once done, we can do everything else either remotely or from our local branch. They also said an out-of-state bank will probably ask the firm to sign an attorney certification, which they won't do.

A banker at Chase Private Client in NYC that our late family member worked with says a that estate account can be opened at any Chase branch in the country. Their Branch Manager re-confirmed this and said they open estate accounts for out-of-state administrators all the time and just change the state to match the letters provided during account opening.

I found this on the NY courts' law library site: "The fiduciary must then open an estate bank account in a bank, trust company, savings bank, savings and loan association or federal savings and loan association in the state of New York... (SCPA 1307)."

Questions:
1.) Is there a legal requirement that the account be physically opened at a bank in New York like our attorneys are saying? Per them, if the bank account is opened outside of New York, that would be akin to the assets leaving the state and out of the purview of the New York Surrogate Court, which is why they would refuse to sign off on any attorney verification letter.

2.) If the account is opened at a New York branch, can the second administrator sign remotely from another state?

FWIW, I tried walking into my local Chase branch on Friday to ask this question and it seemed like they didn’t want to deal with a New York Estate. They were telling me all paperwork goes through legal and it being an out-of-state Estate may cause delays that otherwise may not happen by just making the quick trip and opening the account in New York (granted it was almost 5 PM on a Friday so who knows). I work in Financial Services/Wealth Management here in FL and have never heard of a process be as archaic as needing to be physically present in another state to open it.

Thank you all in advance! I will eventually have to go to New York soon to handle the unsealing of the co-op for a potential buyer that already lives in the building, so going up there is not the worst thing in the world. But, I’d love to get as much of the minutiae out of the way locally/remotely so that I can dedicate my time to cleaning out the place with my family when I do have to eventually fly up there.
