I need some advice regarding a possible pension withdrawal fraud .
Here is what happened:
Brother A and Brother B’s mother passed away. She was receiving a pension, and their father was the nominee.
Approximately a year ago, Brother B’s wife made an online transaction using the deceased mother’s pension account, even though the mother had passed away a month or two before the transaction.
Brother A submitted the mother’s death certificate and a written application to the bank informing them of her death. Despite this, the bank still allowed the online transaction to take place.
After the transaction came to light, the bank, Brother B, and his wife reportedly faced problems. To resolve the matter, they wanted Brother A and their father (the nominee) to sign a written application stating that the transaction had taken place with their consent or approval.
Brother A initially refused to sign because he believed the transaction was fraudulent and had not been authorized by him. However, he later signed the application because he was under pressure from Brother B. As a result, the matter was apparently settled.
My questions are:
Can Brother A now approach the bank again and formally object to the transaction, despite having previously signed an application stating that it was approved?
If Brother A signed under family pressure, can he explain the circumstances and challenge the earlier application?
Can Brother A’s wife also report the matter to the bank or the relevant authorities, or would the complaint need to come from Brother A, their father (the nominee), or another legally authorized person?
What action could the bank take if a fresh written complaint is submitted now? Could the bank reopen its internal investigation or refer the matter to the police?
Since the bank had already received the death certificate and notification of the mother’s death before allowing the transaction, could the bank also be held accountable for its role or failure to prevent the withdrawal?
Which authority would be the most appropriate to approach: the bank’s grievance redressal department, the bank’s nodal officer, the RBI Ombudsman, the police, or another authority?
Would the previous signed application prevent further legal action, or could the matter still be investigated if there is evidence of unauthorized withdrawal or misrepresentation?
The main concern is that the transaction may have been fraudulent, but the issue was apparently settled after Brother A signed the application under pressure from his brother.
I would appreciate advice from anyone familiar with Indian banking procedures, pension rules, or criminal law. If possible, please explain what steps could be taken now, what evidence would be useful, and whether there are any time limits for making a fresh complaint.
I understand that the exact legal position may depend on the documents and circumstances, and I am looking for guidance on the appropriate next steps.
