I have a neighbor who regularly has massive fires that burn all day long, with the burn piles approximately 5 feet from my shed and right next to the woods behind my house. From what I understand, this violates Georgia’s outdoor burning safety rules requiring fires to be at least 50 feet from structures and 25 feet from woodlands.
The neighbor had several trees cut down and is now cutting them up themselves. Because they’re processing the trees on-site, the wood is apparently being treated as hand-piled yard debris, even though some of these logs are nearly 2 feet in diameter. I believe the large logs are contributing to the excessive smoke because they burn for so long.
The smoke and smell are becoming unbearable. It covers my yard and drifts into my home. I’ve tried talking to the neighbor, but that hasn’t gotten me anywhere. I was going to wait for him to just finish but it seems more and more tees are coming down. I am on day 20 or so of this.
I live in Walton County, Georgia, and I’ve contacted the Fire Marshal, the fire department, and the Georgia Forestry Commission. Unfortunately, each agency has told me they don’t have the authority to enforce these rules and keeps directing me to another agency.
At this point, I’m not sure where else to turn. I understand that people can burn yard debris on their own property, but surely there are limits when it comes to fire safety and smoke constantly affecting neighboring properties.
Has anyone dealt with a similar situation in Georgia, particularly in Walton County? Who actually has the authority to enforce these rules, and what options do I have to get this addressed?
